Offshore Delivery laws changed back to 90 days out of state!

Owners of yachts will once again be able to avoid paying sales tax if they keep those items out of the state for just 90 days after purchase. That's how the law worked before 2004, when lawmakers changed the law by requiring state residents to keep those purchases out of the state for a year to receive a sales tax exemption.

A provision intended to keep the one-year requirement in place was removed from the budget last month at the insistence of Senate Republican Leader Dick Ackerman of Irvine.

Ackerman said in an interview that the stiffer rules were pushing yacht brokers and manufacturers out of the state. The boost in sales tax payments was the result of more Californians buying jet skis and smaller vessels, not yacht owners forgoing that long trip to Mexico, he said.
Gov. Arnold Schwarzenegger has worked with Democrats to keep the one-year requirement in place. It had been renewed each year since it was enacted -- until now.
"This was going to be an experiment," Ackerman said of the 2004 law -- one he believes has failed. Others

What is an Offshore Delivery all about?

For many years clients have chosen to take delivery of their boat in a location outside of California, in order to use it in a location outside of California.  One of the advantages of this practice is that the dealership is not required to collect sales or use tax (approximately 8% of the purchase price, depending on the county in which you purchase the boat).  California requires that a retailer collect or a buyer of a brokerage boat pay a sales tax on the purchase. The only exception is when a client requests, and takes delivery outside of the state.  This will keep them from paying the sales tax, but they will be liable for a Use Tax (coincidently the same amount as a sales tax) unless they follow very specific rules and did not “intend” to bring it back or to keep it out for the purpose of avoiding sales/use tax.  Below you will find a list of 8 key summary points to consider and a list of 3 attorneys’s who specialize in this type of transaction. We highly recommend using an attorney to insure you follow the intent and letter of this tax code. This list is meant as a general guideline and should not be solely relied on to make your decision to take an offshore/ out of state delivery.

  1. The Purchase contracts (new or brokerage) must state that the offshore delivery as a contingency.
  2. The purpose is NOT TO AVOID SALES TAX.
  3. You should not keep your current slips or anything that could prove you intend to return to California.
  4. California residents must keep the boat out a minimum of 3 months.
  5. The client must keep all records of usage out of the state to verify it has been used not stored. There is no specific usage amount required by the state; however we suggest you use it as much as possible.
  6. The owner can not use the boat, put equipment on it until he has taken delivery out of the state.
  7. After the boat has taken an offshore delivery it can be brought back into the state for repairs, retrofit or modification.  This work must be documented with work orders and the client can not use the boat for an excess of 25 hours of sailing/ motoring time during the boats return to California.   You must keep a usage log and all paperwork related to the work.  As long as you meet this provision your “out of state” time IS STILL accruing while it is in the state for repair, retrofit or modification.  This can include commissioning time if you do an offshore delivery prior to commissioning process. However you must keep good records of this fact in the event of an audit. This provision does allow you to start his usage provision earlier and give him time to work out the bugs on his boat, as long as you use it less than 25 hours.  The time it takes to deliver the boat to and from California to or from an area outside California is not included in the 25 hours.

New 2008 Hunter 45' DS

The newest addition to the Hunter Models is now on the market and continues to exceed expectations. The beautiful 45DS possesses most of the successful Hunter 44 characteristics but with a few more improvements. Beginning with its larger cockpit, wraparound windshield and dual helm station, this striking larger model still retains its sleek appeal and user-friendly feel.

            In terms of structure, the new model is based upon the same modular method from previous models, with a balsa hull sandwich above waterline combined with solid FRP below the waterline. Layers of Kevlar are in the forward sections providing even more impact resistance. The plywood-cored deck is matched to the hull using an outward flange joint sealed with 5200 and fastened with both screws and bolts. 

            On deck there is a twin wheel configuration that provides enhanced visibility and mobility while sailing. Access from the cockpit to the transom has been improved with the widening of the walkway between the two leather wrapped wheels, which provides for more access and space in general.

The interior features include a Pullman forward cabin layout with the head and shower in the forepeak, allowing for more storage space along the starboard side directly opposite of the double berth mounted on the port side.  Within the expanded aft stateroom there is a centerline queen size birth, a large hanging locker and convenient nightstand shelving. In other words, the cabin is not only spacious but also very comfortable.  

            Overall, the new 45DS raises the bar in design with the customer in mind while upholding the standards that Hunter has developed over the years.

The New Silverton 330 Sport Coupe

The latest model developed by Silverton debuted in the January 2007 boat show in New York. With hardtop configuration and an inside helm station, the two-stateroom 33SC has also been designed to afford a longer boating season with protection from the elements. Without infringing on the boating experience there are full view double sliding glass doors between the cockpit and cabin while still providing fresh air and natural light.

Inside the main cabin there is a sleeper sofa, loveseat, fully equipped galley including a microwave, one-burner electric range, and an under-counter refrigerator/freezer. The forward master stateroom features an angled full size berth with drawer storage, a hanging locker and deck hatch.

On the starboard side, the private wet head has a curtained off shower area and medicine chest. There are also multiple factory installed entertainment and maintenance packages available for this particular model. Great for cruising with family and friends any time of the year.

Maintenance Tips!

Teak Maintenance

There are few ways that all get the job done when it comes to keeping your teak protected and looking great. You can use a varnish or polyurethane, special oils for dressing, or simply let weather naturally turn it a silver-gray color. All work great but it ultimately boils down to personal preference. Although one important step should be taken before applying any of the former methods and that involves cleaning and scrubbing.

New teak that comes straight from the factory contains natural oils and dirt and regardless of how shiny it looks, should be thoroughly cleaned with a two-part cleaner/bleach solution before applying any varnish, oil or sealer. Leaving it without the initial cleanse will eventually lead sunlight to darkening the wood dramatically. Two part cleaners leave your teak looking a beautiful golden brown. One-part teak cleaners are available and are not as harsh on your skin or wood. This type of cleaner should be used when you do not want remove the old finish during in seasonal scrub-down. Be sure to wear rubber gloves and eye protection when handling these chemicals. When scrubbing try and use a soft nylon bristle brush and avoid using steel wool or too much force which can remove the desired soft wood from the teak grain.

Whether you choose to use varnish, oils, or the all-natural method it is important to do that initial cleanse and scrub to keep your teak looking the way you want it. Please call the service department if you have any questions regarding your Teak and how to properly care for it!
