The California State Legislature is set to vote this month on Assembly Bill #1452 pertaining to "out of state" delivery for aircraft, vessels, and vehicles.  The following information is taken from contact yesterday with a maritime attorney who is extremely knowledgeable on this bill:

"...the author of legislation regarding funds for water reclamation projects amended his bill on August 29th to reinstate the 12 month rule for purchases of vehicles, aircraft and vessels.  As of today (9.9.08), it is still in committee, but likely to move forward.  The bill does require a 2/3 vote which may be difficult.  The bill as currently drafted is to be effective immediately upon it becoming law - not retroactive."

Therefore, it appears the brief window of time to benefit from the 90-day offshore delivery policy is coming to a close.  As the information states above, the rule will not be retroactive (as it is currently written), so any purchase made prior to the change will not be affected just so long as there are no contingencies and the purchase agreement is binding.

If you are planning to purchase a boat in the near future and are hoping to utilize the offshore delivery "loop hole", it would be smart to act quickly to benefit from the savings.
